A federal judge in California issued a ruling Thursday that would allow the states to regulate the drug giant Pfizer’s drug business and allow individuals to buy the drug from the United States.
The ruling, which was announced as the Federal Court of Appeal dismissed the claims of two California residents who sued Pfizer after receiving Viagra in 2010, follows a landmark ruling from California’s high court earlier this year that allowed California’s three largest drug makers to start selling the drug without a doctor’s prescription.
In the lawsuit, Judge Cecilia J. Thomas ruled that “Pfizer’s conduct is a clear violation of state and federal laws” because it caused Viagra to be marketed in California.
The California cases arose from the drug’s use in treating erectile dysfunction, the company said in a statement.
A California court judge dismissed the complaint against Pfizer’s three main competitors, including Eli Lilly and Co. and Teva Pharmaceutical Industries.
In January, the federal court judge ruled that the companies could “not be held accountable” for the drug’s health risks because the drugs were approved for use by doctors at a higher level than in the U. S. and have been studied in other countries.
The drug company has filed lawsuits against more than 20 state and federal law-atalieinent states to recover damages for injuries that occurred after Pfizer began marketing Viagra in 2010.
The suit, brought by California residents and from the U. state of California, alleges that Pfizer’s actions were caused by a combination of physical and psychological causes and that the drug company was aware of the risks of Viagra and other drugs to treat erectile dysfunction before the drug was approved by the U. Food and Drug Administration. The suit was dismissed by Judge Thomas.
“Pfizer is a leader in the industry and is responsible for ensuring that millions of men are protected from the harmful side effects of these products,” the lawsuit said in its statement.
The state’s lawsuit was filed by a plaintiff in the California cases. The suit alleges that Pfizer engaged in a practice known as “pharmacy buying,” “pharmacies of the highest quality” and “pharmaceutical sales by the most for a single person.”
Pfizer spokeswoman Mary Anne Arnold, who was present during the oral arguments, said in a statement: “We have no plans to intervene in this litigation.”
The California case is the latest in a series of lawsuits brought by women who claim that the drugs they were prescribed for in the United States were being used to treat women who were experiencing female sexual problems.
The lawsuits involve more than 6,000 women who allege that Pfizer and other drug makers — including Eli Lilly, Bayer and Teva — used these drugs to treat sexual problems in women. The plaintiffs claim that in 2001, the company created “a scheme,” “a scheme,” and “a scheme” to promote these drug products.
The suit was filed in October 2002 in California court.
The suit contends that the drugs are “prescribed for the treatment of sexual disorders of the female genitalia in women, such as erectile dysfunction.”
According to the lawsuit, the drugs include sildenafil (Viagra), tadalafil (Cialis) and vardenafil (Levitra).
In addition to the drugs, the plaintiffs claim that Pfizer knew or should have known about the dangers of these drugs before taking Viagra, including the use of the drug to treat sexual problems in women.
The drugs included the active ingredient, sildenafil, which is marketed by Eli Lilly and sold under the brand name Levitra. The plaintiffs allege that the drugs caused their symptoms, including a decrease in vaginal and sexual interest, and other problems.
In addition to the drugs, the plaintiffs are alleging that Pfizer violated state and federal laws, including the Food and Drug Administration Act, and the federal Food, Drug, and Cosmetic Act.
According to the lawsuit, the companies marketed the drugs in California and other states “for a variety of reasons, including the use of the products to treat the male sexual disorder, erectile dysfunction.”
The defendants in the cases filed in California court claimed that the drugs were used to treat male sexual disorders and that the drug was designed to treat the symptoms of erectile dysfunction in women.
